SHIPPING: INFORMATION AND COSTS

LAM SPORTS s.r.l. in this contract is indicated and defined for all legal purposes with the words “Peter Sagan Shop”, which is the official selling platform of Peter Sagan’s merchandising.

Peter Sagan Shop is regularly in contact with the national and international delivery services to identify the best service in terms of timing, the lowest shipping costs for each country, guarantee of delivery and customer service. The products ordered are delivered to the address specified by the customer on the order form. Deliveries are made Monday through Friday during normal business hours, except on national holidays and during business closures. When the order is handed over to the delivery service, the customer will receive an email containing the estimated delivery date, location of the parcel will be made available to customers from the moment it is received by the courier until actual delivery. Delivery is considered completed when the products are made available to the customer at the address specified on the order form. Upon delivery of the products by the courier designated by Peter Sagan Shop, the customer should carefully check that the number of items delivered corresponds with the number indicated in the transport document.

Any damage to the products, or a discrepancy in the number of items, packages or other information, must be immediately reported by the customer, who may contact Peter Sagan Shop through paypal@petersagan.com, specifying the order to which the problem applies.

 

NON-DELIVERY

In case of non-delivery due to the absence of the recipient at the specified address, the courier will send an email alert to the customer with a link that he or she can use to make an appointment for delivery. The customer may indicate a date and whether the driver should arrive in the morning or afternoon, or choose to get the good from the closer DHL point. If it is not possible to complete the delivery on the agreed-upon day, due again to the absence of the recipient, Peter Sagan Shop will attempt to contact the customer to schedule a new delivery. In the event of a further failure to deliver due to the absence of the recipient, the order will be returned to Peter Sagan Shop After 30 days from the date on which the products were returned to Peter Sagan Shop due to the inability to complete the delivery, the contract will be terminated and the purchase order canceled pursuant to Article 1456 of the Civil Code. The termination of the contract and the amount of the refund will be communicated via email. The refund amount will be credited via PayPal. In the event that, before the expiration of the 30 days, the customer asks for the purchased products to be delivered again, Peter Sagan Shop will proceed with a new delivery, subject to a delivery charge in addition to the cost of returning the products to Peter Sagan Shop and the cost of storage.

 

METHOD OF PAYMENT

Peter Sagan Shop allows for a single method of payment through PayPal, an eBay company, which offers a quick and secure online payment system. When the customer chooses to pay with PayPal, the amount is charged directly to the selected credit card (Visa, Visa Electron, Mastercard) or prepaid debit card (PostePay). PayPal protects the buyer’s financial information and does not transmit it. After every transaction executed by this method, PayPal will send an email confirmation. The order amount is charged to the customer’s PayPal account at the time of order.

 

Customers based in Italy: €7.50 National Service (only on Italian territory) – transport via ITALIAN POST COURIER SDA.
Customers based outside of Italy: Shipping costs depend on the country of destination. Once the products have been selected, proceed with the purchase and select a destination country to see the corresponding shipping costs.

Customs clearance costs, which depend on the type of items purchased and variate from country to country, shall be paid by the customer.

DELIVERY TIME

Peter Sagan Shop provides delivery within 96 hours of receipt of the order by our couriers. The delivery time may vary due to circumstances beyond our control, such as weather conditions and strikes. Deliveries are made Monday through Friday during normal business hours, excluding national holidays and business closures, to the address specified at the time of order placement. The order status is always made available by DHL, where the location of the package can be tracked from the moment it is received by the courier until actual delivery.

 

SATISFACTION OR YOUR MONEY BACK

Every customer of petersagan.com can exercise the right of withdrawal from the purchase contract in the event that one or more of the products received is not satisfactory.

A request for an eventual return of goods must be made within 7 days of receipt. Peter Sagan Shop will determine whether such a request can proceed and authorize it by email. Only then can a customer ship the said goods. All returned items shall be in their original packaging and shall not be worn, washed, altered in any way whatsoever or show any sign of use. All returned packages will be thoroughly inspected.

The cost of transport will remain a customer load.

3.2 All the products offered are explained on the website, within the respective sections, divided by product category.
3.3 The visual representation of the products on the website, when available, is indicative, usually corresponds to photographic images of the products, and has the sole purpose of presenting them for sale, without any guarantee or commitment by Peter Sagan Shop concerning the exact correspondence of the image depicted on the site with the actual product, in particular with regard to the actual size and/or color of the product.
3.4 In the event of a difference between the image and the written product description, the description of the product should be relied upon.

4. Purchase procedure
4.1 Following the outlined technical procedures, the customer may purchase the products in the electronic PS catalog, presented in detail on the website within the sections for the various product categories and described in the relevant product information contained on the site.
4.2 To purchase products, the customer must register on the website by entering his or her personal details, following the instructions provided during the registration process, and complete and submit to Peter Sagan Shop the electronic order form available on the website, following the instructions provided. 5. Conclusion of the contract

8.5 Deliveries are made Monday through Friday during normal business hours, excluding national holidays and business closures, in the manner specified by the courier selected by the customer. 8.9 Force majeure, unavailability of means of transportation, and unforeseeable or unavoidable events that cause a delay in delivery or make deliveries difficult or impossible or cause a significant increase in the delivery costs incurred by Peter Sagan Shop give the company the right to divide, postpone or cancel the delivery, in whole or in part, or to terminate the purchase agreement. In such cases it is the responsibility of Peter Sagan Shop to provide timely and adequate notice of its decision, using the email address specified by the customer. The customer will be entitled to a refund of any money already paid and will have no further claims of any kind against Peter Sagan Shop

11. Intellectual property rights
All trademarks (registered or not), as well as any and all intellectual work, distinctive signs or names, images, photographs, written text or graphics, and more generally any other intangible assets protected by copyright laws and international conventions regarding intellectual and industrial property, reproduced on the website are the exclusive property of LOMBO PROMOTION LIMITED and/or its assignors, and access to the site and/or entrance into purchase contracts gives the customer no right over them. Any use of them, including only partial use, is forbidden without the prior written consent of LOMBO PROMOTION LIMITED, to which all rights are exclusively reserved.

12. Governing law and jurisdiction
12.1 These terms and conditions and any and all contracts entered into with the customer are governed by Italian law. International treaties regarding the sale of goods are specifically excluded, with particular reference to the Vienna Convention of 1980.
12.2 The solution of any controversy deriving from the interpretation and application of the present contract will be referred to an arbitration board, having its registered office in Pordenone, according to the procedure established and foreseen by the articles. 806-840 c.p.c.

In any further dispute relating to the interpretation, execution, validity or effectiveness of these terms and conditions and any customer contracts, the Court of Pordenone will have exclusive jurisdiction, except in cases in which a party is a “consumer” pursuant to Legislative Decree No. 206/2005.
