LAM SPORTS s.r.l. in this contract is indicated and defined for all legal purposes with the words “Peter Sagan Shop”, which is the official selling platform of Peter Sagan’s merchandising.
Peter Sagan Shop is regularly in contact with the national and international delivery services to identify the best service in terms of timing, the lowest shipping costs for each country, guarantee of delivery and customer service. The products ordered are delivered to the address specified by the customer on the order form. Deliveries are made Monday through Friday during normal business hours, except on national holidays and during business closures. When the order is handed over to the delivery service, the customer will receive an email containing the estimated delivery date, location of the parcel will be made available to customers from the moment it is received by the courier until actual delivery. Delivery is considered completed when the products are made available to the customer at the address specified on the order form. Upon delivery of the products by the courier designated by Peter Sagan Shop, the customer should carefully check that the number of items delivered corresponds with the number indicated in the transport document.
Any damage to the products, or a discrepancy in the number of items, packages or other information, must be immediately reported by the customer, who may contact Peter Sagan Shop through email@example.com, specifying the order to which the problem applies.
In case of non-delivery due to the absence of the recipient at the specified address, the courier will send an email alert to the customer with a link that he or she can use to make an appointment for delivery. The customer may indicate a date and whether the driver should arrive in the morning or afternoon, or choose to get the good from the closer DHL point. If it is not possible to complete the delivery on the agreed-upon day, due again to the absence of the recipient, Peter Sagan Shop will attempt to contact the customer to schedule a new delivery. In the event that, before the expiration of the 30 days, the customer asks for the purchased products to be delivered again, Peter Sagan Shop will proceed with a new delivery, subject to a delivery charge in addition to the cost of returning the products to Peter Sagan Shop and the cost of storage.

When the customer chooses to pay with PayPal, the amount is charged directly to the selected credit card (Visa, Visa Electron, Mastercard) or prepaid debit card (PostePay). The order amount is charged to the customer’s PayPal account at the time of order.

All returned packages will be thoroughly inspected.

4. Purchase procedure

If it is again not possible to complete the delivery due to the absence of the recipient, Peter Sagan Shop will attempt to contact the customer to schedule a new delivery. 8.9 Force majeure, unavailability of means of transportation, and unforeseeable or unavoidable events that cause a delay in delivery or make deliveries difficult or impossible or cause a significant increase in the delivery costs incurred by Peter Sagan Shop give the company the right to divide, postpone or cancel the delivery, in whole or in part, or to terminate the purchase agreement. In such cases it is the responsibility of Peter Sagan Shop to provide timely and adequate notice of its decision, using the email address specified by the customer. The customer will be entitled to a refund of any money already paid and will have no further claims of any kind against Peter Sagan Shop

11. Intellectual property rights
All trademarks (registered or not), as well as any and all intellectual work, distinctive signs or names, images, photographs, written text or graphics, and more generally any other intangible assets protected by copyright laws and international conventions regarding intellectual and industrial property, reproduced on the website are the exclusive property of LOMBO PROMOTION LIMITED and/or its assignors, and access to the site and/or entrance into purchase contracts gives the customer no right over them. 12. Governing law and jurisdiction
12.1 These terms and conditions and any and all contracts entered into with the customer are governed by Italian law. International treaties regarding the sale of goods are specifically excluded, with particular reference to the Vienna Convention of 1980.
12.2 The solution of any controversy deriving from the interpretation and application of the present contract will be referred to an arbitration board, having its registered office in Pordenone, according to the procedure established and foreseen by the articles. 806-840 c.p.c.
In any further dispute relating to the interpretation, execution, validity or effectiveness of these terms and conditions and any customer contracts, the Court of Pordenone will have exclusive jurisdiction, except in cases in which a party is a “consumer” pursuant to Legislative Decree No. 206/2005.
